Palmer-Winan-Davis Murder
A 10-year-old boy is charged with arson of his own home and for murder in the deaths of Chanan Palmer (his mother) and four others. Over the protest of the victim's relatives, the boy was released to the custody of his grandmother. The ten year old denies all the charges. He is represented by attorney, David Rohrer, in the criminal case pending before Darke County Juvenile Court Judge Michael McClurg. Rohrer contends that while the boy was read his rights before questioning, his age prevented him from understanding the situation.
Some people cheered the boy's release from the juvenile facility in nearby Troy, Ohio. The boy survived the September 16 fire that killed his mother, Chanan Palmer; his half-sister Kaysha, 8, and three children of Christy Winans: Kayla Winans, 6; Je'Shawn Davis, 5; and Jasmine Davis, 3. Christy Winans and her boyfriend escaped the blaze with minor injuries.
Darke County Prosecutor Richard Howell admits that the boy didn't give investigators a clear motive. But Howell told the newspaper that the boy is responsible for the fire. Winans' mother, Sabrina Jones, screamed at the boy's supporters outside the court Monday. "My grandkids didn't even see the age of 10," Jones yelled. While police allege that the boy confessed to setting the blaze after three days of questioning. Some claim the boy has been made a "scape goat."
William Zink, pastor of the New Life Pentecostals of Greenville, said the boy attended church and had overcome the recent death of his stepfather from AIDS. "It was not just your 'American pie' family," Zink said. He said the boy had no bed and slept on the couch. The boy will now be under house arrest and staying with grandmother Tammy Reed. A forensic and psychological exam will be performed. The charges against the boy remain as one juvenile count of arson and five counts of murder. (Arson carries a minimum of one to three years in detention. Murder could keep the boy in custody until age 21 However, if the boy is labeled a serious youth offender under Ohio law he could be imprisoned for life.) Zink said the boy is worth saving from the juvenile justice system. ) Some think the boy is innocent. Others think he should be treated as an adult. Furthermore, according to detectives, a gun they found at Kozik's house looks like the one used in the robbery. Heidi Kozik apparently does not have a criminal record. Did you know that they do not allow any accessories in jail? No rings, earrings, bracelets, not even a watch. We all have our own hell, for some it is prison garb with no makeup.

Of course these are allegations - Heidi just got that car, and it is impossible that the same car was seen over the past year in these other robberies. Everybody needs to keep an open persective about this. Isn't it possible that the police want to convert people's attention away from the robberies which nobody has been charged for? Don't people "feel better" knowing that the bad guys are locked up? That's the question here...coupld police just be trying to pin them with crimes that they didn't do to make it appear that they are on top of their jobs? I know that Heidi's car is a new one, and she couldn't have had it before - I'm part of her family.
I agree. These two lived in that small town. Has anyone asked if they banked where the robberies were? How many of us could leave a fingerprint behind when at the teller window? What does this mean if it's all allegations anyway. What evidence do they really have? The gun "looks" like the one they had. So what. Do you know how many responsible gun owners are in the country?
It is not an open and shut case against the Koziks! To my knowledge there has not been any confession. If they keep their mouth shut and try the case on the evidence, a conviction may be difficult. Furthermore, even if they are found guilty of robbing this bank, there is not necessarily evidence that they robbed the other banks.
It's tragic and the kid will have to live with it for the rest of his life but he's ten. Come on people. Here in Chi-Town some kid like 6 got arrested a year or so ago for trying to kiss a few girls in his class. ARRESTED. Last year another kid was arrested for bringing a gun to school for show and tell. At what point does a kid stop being a kid? And why do we insist on suddenly holding children more accountable than we hold adults? How many fathers get away w/out paying child support? And so forth. I should add I have a ten-year-old nephew who is fascinated by fire works and setting them off. He could very likely be in this situation. While setting his house on fire would be tragic and we hope he understands the importance of not setting off anything w/out supervision, or anything we don't approve, he could hardly be charged as an adult or even a child for such a tragedy. I spend a lot of time w/the kid and no way he behaves with the rational or understanding of an adult. Last week, my niece--age two--took off her diaper and dropped it onto the floor. We are having the police charge her with vandalism... she knew what she was doing!
Gee, I drive a 2005 silver Pontiac too! Does that mean whenever a car without a plate number is seen around a robbery that makes the driver guilty?! Is that what our government has turned into - a dictatorship that "if" someone looks like a criminal based on scrapes of evidence, then they are guilty? "If" someone resembles a person on camera, then they "ARE" that person? I'm with Viper on this one...even if they did this one, that still doesn't mean that they are guilty of the others. I say the cops want to show the people that the community is safe, and are using these two to get that point across. And you know what, it could happen to any of us, if that's how thorough a whole "two day investigation" happens to be.
The finger print is explainable. The hat may or may not be linked to the Defendants. The car was apparently without a plate... but that could be because it is new.
Koziks may be innocent. They may be. It is hard to convict someone merely on circumstantial evidence.
To date there is nothing that links the Koziks to the other robberies other than police generalizations.
To my untrained eyes and ears, reasonable doubt is starting to creep up and rear it's head on this one.

Mark and Heidi paid for their wedding with help from their family. We all got together; the cake was home-made, and a friend did the flower arrangements. A cousin whose a DJ brought the music and since it was a dytime wedding, without the frills of a church, a minister presided over the service, and the reception was a lunch at a banquet hall. Since I am a photographer, I did their pictures free of charge. Here's some background...Mark and Heidi aren't built to carry out these numerous bank robberies. They work, and don't mind working. Neither of them wants a fancy life, just a decent living. Yes, I am a relative, and not the same one who posted a previous blog entry here. As far as the case goes, neither Mark or Heidi has seen an attorney. They weren't offered that when they were being questioned. Alot of the evidence is entirely circumstantial. I can't say whether or not either of them could or would rob a bank, but I can say that if everyone doesn't start to pay more attention to the common man, and our rights as citizens, then we've given over ourselves to what authorities have to say. And where does that lead us? Surely not a better place. If anyone is an attorney, or knows of an attorney, Please, get in touch with Mark and Heidi at the Lake County Illinois jail. Let's provide details here instead of allegations, let's give others the benefit of the doubt, when each of us would want the same for ourselves.
That's right. This isn't Law and Order. Everyone is presumed to be innocent until found guilty. There isn't enough evidence here to do that. Media working with police have a way to make the story appear one sided. I will see what I can do, but I'm not in Illinois. Perhaps another attorney who is local could help them?
the kozik's mark and his mother are very evil persons. heidi was coerced into this. mark has a rap sheet a mile long he's a habitual criminal and should be put away forever. heidi has never been arrested for anything she has a clean sheet. mark is an abuser. ans so's his mother she can't live within her means. sponging off her son and his wife. she will have to face God when she dies. and she's not going to heaven. niether is mark. i am a family member.
Does someone who is so "pure" make a comment like this last one? Heidi and Mark are both responsible for whatever they may or may not have done. And, if a family member thinks they have right to hold judgement on another person, maybe they themselves are what they see in Mark and his family.
I agree the evidence is not all that great, but….I say set them up with a considerable trust fund at taxpayer expense, give them an education, cars, homes, medical and dental care, three hots and a cot, TV with cable, freedom from parasites and mosquitoes, an extensive mountain top estate, etc…
I say with all the money we spend on dealing with criminals why don’t we just flat out give it to them? And when they come to our homes to rape and steal, just submit and hope they don’t hurt you. And when they’re done, thank them and give them a hug.

I would like to say this - we don't know how or why they did what they did. I am sure, however, that Heidi did not come up with this scheme. I have known her her entire life and I know she was NOT raised this way. I did see a 180 in her personality when she moved in with Mark. He is one "slick" operator & I believe he in some way compelled her to do whatever her part in this was. I am 100% positive that he was an emotional and physical abuser. His mother is a nut case!
Has anyone ever seen Heidi's old lady? Talk about a crazy lady dealing with major karma. She refused to have anything to do with her own daughter's wedding. The whole family there has issues about guns - their crazy with guns. Heidi is responsible too - it takes two to tango.
Heidi was abused as a little girl. Her parents forced her to sleep on an old floor when she lived with them. The whole house is a shambles and should be reported to the health inspectors.
I'm in Marks' family and I can say that he has troubles - but I doubt if all of these allegations are true. I'd suggest to the people who are throwing stones to shut up - the evidence against them is just that right now unless you people want to see them thrown in jail. Because that's what your mud sligging is going to do. Mark's mom supports herself and is a supportive mom and a good one. If I recall Heidi couldn't even get her parents to pay a dime for her wedding. Mark and Heidi and Mark's family made that wedding possible. This is a positive blog forum not a redneck brigade so keep that in mind.
I don't know any of them, but when people do things in their 30's, it can hardly be the parents fault about anything at that point. As long as parents of people that age support their child's responsible choices and are always there for them then a parent has done their job. I'm sure both Heidi and Mark's parents have been in touch with them and are very concerned.

If you're all family (even by marriage) then communicate like one. Why the cowardice throwing stones on a blog? Don't you have telephones? Getting back to what bloggers said earlier, the case is still pending. It would be a difficult case saying that one was coerced into doing something without knowing that person's emotional history. And that may be more painful to bring up the last 30 years than the case itself! I guess I just don't feed into the "poor victim" thing because that's such a self defeating character trait.

Yeah, that's counter productive to start the blame game. It seems that the first family member to post something asked for help for the Kozik's though. That should be the main issue here. Instead of who was the better parent. All of that comes from a guilty conscience anyway. Stay focused people! It's insulting to women to say that she was forced to do something. Didn't the cop say that the last thing she told him was that she stood by her man? So whose nuts?!

Aren't people being questioned by police entitled to have an attorney present? Was there a warrant issued to search the house for the gun? Whose gun was it, and who is it registered to? Why was a gun in the house of someone with a record (as this is illegal), and who made this possible? There are many questions to answer, and it seems the first order is to get both of the Kozik's help.
Heidi's mom expected a weekly deposit in her bank each week made by Heidi to support the mother's meth habit. That's why she has no teeth.
Get the answers to the following:
1. Did the police have a warrant?
2. who was the registered owner of the gun?
3. Where was the gun found?
4. Did the police advise them of the right to an attorney?
5. Did they make any admissions to the police?
6. Have they made any calls from the jail (these are usually recorded and used as evidence against them.)
7. Get this information, and see if there any attorney's who are willing to help.

You can say whatever you want about Heidi's mom but I would lay my life on the line that HER mother DID NOT have a METH habit - nor did Heidi put money in her bank account . Her mother has breast cancer and has been on chemo & radiation for most of the last year - therefore, she wasn't up to helping Heidi with the wedding plans. Everyone here needs to stop pointing fingers - in case you don't realize it - when you point your finger at someone else you have 3 pointing back at yourself. They are both adults and made some pretty foolish choices. It's to bad, but, now they have to pay the piper. This will all be sorted out in court - one way or the other. Maybe some of you could all volunteer for jury duty to ensure a fair trial? Why don't you start a collection to pay their legal fees too?
This case may or may not go to trial. I may be wrong, but I doubt that you can volunteer to be a juried member for a particular case. The whole point is for impartial jurors who do not have any previous knowledge about the case.

b. Since when do guns have to be registered? I’m not familiar with that state’s law, but many states (mine included) don’t have such laws.

To Everyone on Heidi's & Mark's side of the family: If they honestly did commit this crime then I'm positive one didn't make the other do it, they are adults who can think for them selves and who know right from wrong no matter how their life was growing up or is currently. They are innocent until proven guilty. So why don't you all quit sh*tting on the other side of the family and airing your dirty laundry on public blogs. The honest truth is no one side of the family really knows the other. You all don't even really know what went on between the couple.

Heidi's Mother is NOT a meth head, and she does have cancer. And Mark's mother is a wonderfully sweet woman who has always been there for her family. Heidi is my niece - do I know if she is guilty or not? NO.Do I think she made some poor choices? YES! However, the mud slinging at her mother, who is my sister, is totally uncalled for. Heidi NEVER signed her paycheck over to her mom, nor did she deposit money into her mom's bank account. My sister is not & never has been a drug addict. She & Heidi were very close until Heidi met Mark. Do we blame Mark for that? NO. Heidi was an adult and the choice was hers.It doesn't matter. I can say without a doubt that Heidi was never made to sleep on the floor. Did she have the best house on the block - NO. Her parents are not rich and have strived to live within their means. Heidi NEVER lacked for love. My sister chose to be a stay at home mom so they may have done without material things but NEVER without love. They were never abused either. Heidi is still very much loved by us. Are we a dysfunctional family? Probably. We did not make the choices for Heidi & Mark - they made their own so quit trying to place the blame on the rest of the family. We do communicate on this side of the family quite well - Thank you! I once saw Heidi's mom in her backyard. It was in the middle of the afternoon and she was in her underwear drinking scotch from the bottle.
I don't either Mark or Heidi. But, re-reading these blogs, the first one who slung mud, actually a mudball, looks like it was from Heidi's family directed at the Kozik's. You people should concentrate your efforts on Mark and Heidi instead of airing your family disputes, which probably would be there anyway, regardless of what these allegations are about. And, don't throw it if you can't catch it.

I'm Adam, Mark's brother. Most of the absurd comments here come from people who should be getting out more. I don't know Heidi's parents all that well but they seem like people who do their best. My parents are divorced but my mom was always a good mom. If anyone has any comments about that forget the blog and prove how courageous you are and come see me yourselves. I know that Heidi is terribly in love with Mark, and Mark always used kid gloves with Heidi. They worked hard and they were like any other starting out couple. I don't believe they are guilty of all of these robberies. And what they need is support and good thoughts. Amazing how some people have so much time to bring religion into this. The accused company will need the help of their families. The best relatives can do is be supportive and help the public defenders or private counsel who will represent them with reference to this matter.

The police may have stated to the media that the Kozik's have confessed, though there is no official confession on file, as of this date. The court date has been pushed back. Speculation says that there still is no evidence, or a confession on record.

Anonymous makes a great point. Just because the police say they confessed, does not mean the Koziks did confess. There apparently is no written confession and it will be the Koziks word against the police officer's word.
If Kozik has prior convictions, he might not testify. Often Defendants never take the stand. If he does not testify, a jury may believe the police. For that reason, a Defendant who is innocent may choose to take the stand and say yes I did x, y, z in the past but I had married and decided to turn over a new leaf... I was framed. I was charged because of my past not because of the evidence...
I fled because I was in the wrong place at the wrong time. I was scared. I feared that I would be accused because of my past etc...
Let's see whether the police have a recorded statement and whether it is admissible...

If Mrs. Kozik does not have a record, she may be offered a plea in exchange for future testimony. While this may break up the marriage, it may save her from much jail time.

Updates: A private civil suit will be enetered against detective Norris for flase allegations with the intent of personal gain. Was it really worth it? All of the charges originally filed have been dismissed. The alleged fingerprint, as it turns out, was taken from the home, after an illegal search w/o a warrant. No evidence is admissable as of this time. As a result, the allegations made by both the detective and the police is being sudied with a fine toothed comb. Both Mark and Heidi have good defense attorneys who are closely working with them.
to add insult to injury, the detective sold the story, not to Newsweek or USA Today, but to a valid news paper called the National Enquirier...how's that for self sensationalism? Hoping the detective gets to say hello to the couple while he's making new friends of his own in prison! The real crime is police corruption.

interesting find, as neither are being held in lake county anymore. mark and heidi has their own reputable criminal attorney. an investigation of charges is currently underway and further news should be available soon.

Because of the methods used by Spring Grove Police at the time of arrest, and specifically the illegal search of the Kozik's home, information about charges cannot be released at this time. Both Heidi and Mark are in good legal hands, and appreciate your thoughts and support, as do both their families.
Tell them good luck. They have rights just like every one else. NO one, including the police, are bigger then the law. The old fruit of the poisionous tree doctrine can be a suspects best friend.

To all the cowards who are afraid to leave your names the only thing I know is that the gun they found at the home was given to Heidi by Heidi's father. I know this because they were caught firing it at my now home in Wisconsin. Marks Mother is a Saint who would bend over backwards for any family member. Heidi also wrote me from prison that she was thinking of testifying against someone she witnessed murdering another human being to get a reduced sentence. I don't know who that person is but if she is involved with people like that then enough said. Neither one of them are angels but I truly beleive they are being held unjustly. If innocent until proven guilty why have they been incarcerated for a year and a half already. And they do not have good counsel only public defenders who have only seen them a few times in a year and a half. You wanna talk shit leave your names assholes!

Is it ever enough bail if you are a victim of the crime? Is it ever low enough if you are the loved one of the suspects?
If innocent, Mark, it is a miscarriage of justice for them to be in jail all this time without a trial.

He wouldn't have thought up robbing these places on his own. And a couple more things the gun they found what makes it stand out oh it hold bullets. May 4, 2011 Louis A. Bianchi, McHenry County State’s Attorney, announces that Heidi L. Kunz, 33, previously of Spring Grove, was sentenced today to twelve years in the Illinois Department of Corrections for the class X felony offense of armed robbery following a negotiated plea.

The defendant admitted to robbing the Payday Loan Store in McHenry, Illinois on December 15, 2006.
A criminal investigation revealed that Kunz served as the getaway driver.
She is currently serving a separate sentence in the Federal Penitentiary for a bank robbery that occurred near the time of this offense.
Charges against the co-defendant, Mark Kozik, who also is in federal custody, are currently pending.
This case was investigated by Detective John Birk of the McHenry Police Department. The Crystal Lake Police Department, the Fox Lake Police Department, and the Antioch Police Department also assisted in the investigation.
This case was prosecuted for the State by Assistant State’s Attorney Sharyl Eisenstein.
Kunz is currently “in transit” to a Federal prison. Her term runs until 11-15-20.
Mark Kozik is currently in Atlanta’s Federal Penitentiary. He is due to get out on 1-30-29.
I was a friend of Heidi's father and met her when she was in high school. She was sweet and wanted to be a chef. It's sad to learn that she wandered down a path that would ultimately ruin her life. Who led who in the relationship is a question only Heidi and her husband can answer. She'll likely get out before she's aged, but her's will be a lonely, depressing life, filled with remorse.
